Your booking is only confirmed once you receive a booking confirmation email from miamiviceyachts@gmail.com with your unique reference code (see Section 8 — Booking Confirmation). Until you receive this email, no charter slot is reserved on your behalf.

Once confirmed, cancellations are governed by our full Cancellation Policy. In summary:

• A 50% deposit is required to confirm every booking and is non-refundable under any circumstance, as it covers our upfront prepayments to captains, crew, yacht owners, and add-on vendors.
• Cancellations made 7 or more days before the charter are eligible for a reschedule, subject to availability, within 12 months of the original charter date (same yacht; holiday or special-event pricing may apply).
• Cancellations made less than 7 days before the charter, and no-shows, result in no refund of any amounts paid.

Yachts MiamiVice may collect information from visitors about their interactions with our website. This information is used to improve our services, personalize recommendations, and provide seamless booking experiences. Your privacy is paramount and we adhere to strict data protection standards. By using our website, you consent to Yachts MiamiVice using your interactions and preferences for advertising, marketing, and personalized offers — including birthday promotions, anniversary discounts, and exclusive client offers. Your information will always be anonymized where applicable and handled in compliance with privacy laws. We may send you special offers, booking reminders, and wishes on important dates.

At Yachts MiamiVice, we are committed to delivering exceptional charter experiences. To enhance your journey, we offer a variety of premium add-on services at an additional cost — including food catering, private chefs, bartenders, DJ services, luxury transportation, massage therapy, event decoration, photography, water toys, and florals — through carefully selected third-party partners.

While we carefully coordinate with these providers, Yachts MiamiVice does not assume responsibility for any unforeseen incidents, delays, damages, or issues related to these services. This includes, but is not limited to: food preparation concerns (temperature, timing, allergies), vendor delays, transportation timing, equipment malfunction, and service quality.

All additional services are provided under the sole responsibility of the respective vendors, and any claims or disputes must be addressed directly with them.

Extra services come at an additional cost and are not included in the base charter price. Any discounts, promotions, or special offers from Yachts MiamiVice apply exclusively to the yacht charter — not to optional add-ons, which are priced independently by third-party providers.

All add-on services are subject to vendor and yacht availability at the time of charter confirmation. While we make every effort to fulfill selected add-ons, certain items may become unavailable due to inventory, scheduling, weather, or third-party vendor constraints.

If an add-on you've selected becomes unavailable:

• It will be removed from your order before payment is finalized
• Your balance due will be reduced by the price of the removed add-on
• No refund is required for removed add-ons that were never paid for
• You will receive an updated booking summary reflecting the adjusted total

This adjustment is a normal part of our confirmation workflow and does not constitute a cancellation, breach, or grounds for chargeback. The base charter price and any confirmed add-ons remain binding once the booking is approved and the deposit is received.

Yachts MiamiVice LLC is not obligated to substitute unavailable add-ons with alternatives, but our team will offer suitable replacements when possible at the client's discretion.

Pricing on our website is updated in real time and may change without prior notice. Yachts MiamiVice is not obligated to inform clients about price adjustments. The price displayed at the time of booking is the final confirmed price for that reservation. It is your responsibility to review current pricing before completing any booking.

Yachts MiamiVice accepts payment through several secure methods, including Zelle, Apple Pay, Venmo, Cash App, and credit card via Square. Our team will arrange your preferred payment method after your inquiry is reviewed.

For credit card payments, we use Square — a leading global payment processor — to ensure transactions are secure. Square uses industry-standard PCI-compliant encryption protocols, and we do not store your credit card information on our servers.

A 4% convenience fee applies to payments made by credit card (via Square), Venmo, and Cash App to cover third-party processing costs. Zelle and Apple Pay are not subject to any processing fee.

You remain responsible for maintaining the security of your personal and payment information while using our services.

Your booking of a yacht, vessel, or any additional services with Yachts MiamiVice is confirmed only when you receive a booking confirmation email from miamiviceyachts@gmail.com.

Every confirmed booking includes a unique reference code along with all reservation details — date, time, charter duration, yacht name, add-ons, and final total. Without this email confirmation, your booking is not secured. Please ensure you receive and review the confirmation to verify all details.

Charter payments are collected in two stages. A 50% deposit is required to confirm your booking once availability is approved. The remaining balance (the other 50% plus any confirmed add-ons) is due no later than 24 hours before the scheduled charter start time.

For bookings made within 24 hours of the charter, the full charter amount must be received and cleared before the charter can begin.

It is the client's sole responsibility to ensure all payments — both the deposit and the balance — are completed with sufficient time for funds to clear. Delays caused by banking processes, intermediary banks, currency conversion, or third-party payment services do not exempt the client from this policy.

The 50% deposit is non-refundable once the booking is confirmed, except as expressly provided in the Cancellation Policy. Any payments received after the required deadline are non-refundable and will be applied toward administrative, operational, and lost-opportunity costs, regardless of whether the charter operates.

By submitting a deposit and/or balance payment, the client acknowledges and accepts these terms. In the event of a chargeback or payment dispute, this policy and the client's acceptance of it will serve as legal evidence that Yachts MiamiVice LLC fulfilled its obligations and that any non-operation of the charter was due solely to the client's failure to finalize payment on time.

Yachts MiamiVice LLC bears no responsibility or liability for any losses, damages, or additional costs incurred by the client as a result of canceled or postponed charters due to non-payment or late payment.

While we strive to provide accurate and up-to-date information on our website, Yachts MiamiVice cannot guarantee the absence of errors or omissions. We are not responsible for any losses, damages, or inconveniences resulting from inaccuracies on our website. We recommend verifying all information with our team before making any booking decisions.

Yachts MiamiVice collaborates with select third-party sponsors whose businesses may be displayed across our platforms, including but not limited to: our website, booking confirmation emails, social media channels, luxury transportation vehicles, and promotional banners or screens inside our yachts. These sponsor advertisements are provided solely for informational and promotional purposes.

Yachts MiamiVice does not endorse, guarantee, supervise, or assume responsibility for any products, services, communications, transactions, pricing, delivery, or experiences offered by our sponsors. Any interaction, purchase, order, reservation, or service agreement between a client and a sponsor is made exclusively between those parties.

Yachts MiamiVice shall not be held liable for misunderstandings, misrepresentations, disputes, cancellations, delays, damages, or dissatisfaction arising from sponsor-related services or products. Clients are responsible for verifying all details directly with the sponsor before engaging in any service or transaction.

By proceeding with any sponsor offering, the client acknowledges and agrees that Yachts MiamiVice bears no responsibility or legal liability for the sponsor's actions, operations, or service outcomes.

If a client requests to extend the duration of the charter while the charter is already in progress, the pricing for the additional time is not calculated by dividing the original charter price by the number of hours booked.

Extension pricing is separate and independent from the original booking rate and is subject to multiple factors, including but not limited to:

• Yacht availability after the scheduled charter
• Crew scheduling and overtime
• Marina and docking limitations
• Operational and fuel considerations
• Demand and timing (same-day premium)

As a result, the rate for additional charter time is often higher than the original hourly rate, unless Yachts MiamiVice LLC chooses, at its sole discretion, to offer a reduced or promotional extension rate.

• Must be approved by the captain and Yachts MiamiVice LLC
• Are subject to yacht availability and operational conditions
• Must be paid in full before the extension begins
• Are not guaranteed and may be declined for any reason

Yachts MiamiVice LLC reserves the full right to determine extension pricing and availability on a case-by-case basis.

Per Florida law effective July 1, 2025, any main charterer born on or after January 1, 1988 is required to complete an approved Boating Safety Course before signing the Charter Agreement. The certificate must be submitted to Yachts MiamiVice before the charter begins. Charters will not commence without proof of certification for applicable charterers.

In addition to these Terms and Conditions, the main charterer is required to sign a Charter Agreement specific to the yacht being booked before the charter begins. Each yacht may have its own rules, requirements, and responsibilities as established by the yacht owner and captain.

• Choosing the crew (captain and mate) assigned to the charter from the options provided by the yacht owner
• Reviewing and signing the individual Charter Agreement before the charter commences
• Ensuring all guests follow the instructions and rules outlined in that Charter Agreement — including guest count limits, boarding procedures, conduct rules, food and beverage policies, dress code, smoking restrictions, and any yacht-specific safety requirements

Failure to comply with the individual yacht's Charter Agreement may result in charter termination without refund, at the discretion of the captain and Yachts MiamiVice LLC.

All guests must follow the captain's instructions at all times. The captain has full authority over the vessel, route, and all decisions related to safety and operation.

Yachts MiamiVice reserves the right to terminate any charter without refund if guests:

• Engage in unlawful behavior
• Refuse to follow safety instructions
• Bring unauthorized substances, weapons, or illegal items onboard
• Create unsafe or disruptive conditions
• Violate the individual yacht's Charter Agreement
• Exceed maximum guest capacity as established by Coast Guard regulations

The captain's decisions regarding guest conduct, route, and charter termination are final.

The main charterer is financially responsible for any damage to the yacht, equipment, or property caused by the main charterer or their guests during the charter — including but not limited to:

• Damage from spills, broken equipment, or misuse of onboard facilities
• Graffiti, markings, or intentional property damage
• Theft or loss of yacht property, linens, or equipment
• Damage caused by bringing unauthorized items onboard (e.g., red wine, hard-soled shoes, pets without approval)

Repair, replacement, or cleaning costs will be assessed by the yacht owner and captain, and the resulting amount will be invoiced to the main charterer, who agrees to pay such charges promptly. The main charterer agrees to cooperate fully in any damage assessment and resolution process, and remains personally liable for all such amounts regardless of payment method used for the original booking.

Yachts MiamiVice LLC is not liable for any failure or delay in performing obligations due to causes beyond our reasonable control, including but not limited to: hurricanes, tropical storms, government-mandated shutdowns, port closures, pandemics, acts of war, civil unrest, terrorism, strikes, or other extraordinary circumstances.

In such events, we will work in good faith with affected clients to reschedule their charter. If rescheduling is not possible, refunds will be issued for the charter portion of the payment, in accordance with our Cancellation Policy. Add-on refunds are subject to the individual third-party vendors' cancellation policies.

The main charterer must be at least 18 years of age and must present a valid government-issued photo ID before the charter begins. Accepted forms of identification include a passport, driver's license, or state-issued ID.

Charters will not commence without valid identification of the main charterer.

The client agrees to indemnify, defend, and hold harmless Yachts MiamiVice LLC, its captains, crew, vessel owners, employees, contractors, agents, and partners from any and all claims, liabilities, damages, losses, costs, or expenses — including reasonable attorney's fees — arising from or related to:

• The client's use of our services or website
• Any breach of these Terms and Conditions by the client
• Actions, conduct, or omissions of the client or their guests during any charter
• Damage to the yacht, equipment, or property caused by the client or their guests
• Violation of any applicable law or regulation by the client or their guests

By participating in a Yachts MiamiVice charter, you acknowledge that photos or videos may be taken for promotional purposes — including our website, social media, marketing materials, and partner communications.

If you prefer not to be included in any promotional media, please notify the captain before departure, and we will make reasonable efforts to exclude you.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms, the website, or our services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and the parties consent to the personal jurisdiction of such courts.

If you create an account on our website, you agree to provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

New account holders are eligible for a $200 credit applied toward their next charter with Yachts MiamiVice. The credit is valid under the following conditions:

• The credit applies exclusively toward add-on services (catering, private chef, bartender, DJ, decorations, luxury transportation, photography, water toys, etc.) — not toward the base charter price
• A minimum of $600 in add-ons must be purchased on the next charter for the credit to apply
• The credit is valid one time only per account and cannot be combined with other promotions or applied retroactively to past bookings
• The credit has no cash value and is non-transferable
• Yachts MiamiVice reserves the right to modify or discontinue this program at its discretion

Account-related benefits are governed by their respective terms and may be modified or discontinued at our discretion.

By using Yachts MiamiVice's website and services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
